Title: Court Throws Out Anyanwu’s Suit on PDP Secretaryship, Declares Case Abuse of Process Date Published: 20 January 2026 Description: The Federal High Court in Abuja has dismissed a suit filed by Senator Samuel Anyanwu seeking to affirm his position as National Secretary of the Peoples Democratic Party (PDP).In a ruling delivered on Tuesday, January 20, 2026, Justice M. G. Umar struck out the suit marked FHC/ABJ/CS/254/2025, describing it as an abuse of court process and holding that the matter fell within the internal affairs of the party.Justice Umar ruled that the judiciary lacks the jurisdiction to interfere in the internal leadership arrangements of political parties, noting that the position is well settled by several Supreme Court decisions. The court further held that the issues raised by Anyanwu had already been litigated at various levels of the judicial system, including the Court of Appeal and the Supreme Court, and could not be reopened under a fresh suit.In his judgment, the judge also found that Anyanwu’s tenure had legally expired. Elected in 2021 for a four-year term, the court held that there was no legal basis for his continued claim to the office beyond the expiration of that mandate, particularly after the party’s most recent national convention. The ruling followed the PDP National Convention held in Ibadan, Oyo State, in November 2025, which produced a new National Working Committee led by Kabiru Tanimu Turaki, SAN, as National Chairman. At the convention, the party also announced disciplinary actions against some senior members, including Anyanwu, over alleged anti-party activities. Anyanwu had sought to restrain the Independent National Electoral Commission (INEC) from recognising any PDP correspondence not signed by him, a request the court effectively nullified with its decision. The dispute over the office of National Secretary dates back to 2023, when Anyanwu stepped aside to contest the Imo State governorship election. Upon his return, sections of the party moved to replace him with Sunday Udeh-Okoye.Although the Supreme Court reinstated Anyanwu in March 2025 on jurisdictional grounds, the court declined to unsettle the new leadership structure that emerged from the PDP’s November 2025 convention. With the dismissal of the suit, the Turaki-led National Working Committee remains the recognised administrative leadership of the PDP. As of the time of filing this report, Senator Anyanwu had not indicated whether he would appeal the ruling.
